FERPA and COPPA Privacy Policy and Notice
Children under the age of 13 are permitted to use the Services exclusively under an account established by their parent/guardian or school/educator. Any other usage of the Services by children under this age is expressly prohibited. If a Member is a school or educator in the United States and wishes for its students to use the Services, the Member bears the responsibility of complying with the U.S. Family Educational Rights and Privacy Act (“FERPA”) and the Children’s Online Privacy Protection Act of 1998, along with its rules (collectively referred to as “COPPA”).
Insofar as MH Alliance LLC, in conjunction with its associated entities (collectively referred to as “MHA” or the “Company”), has access to “education records,” as defined by the Family Educational Rights & Privacy Acts of 1974 and its implementing regulations (“FERPA”), it is deemed to function as a “school official” with “legitimate educational interests” in fulfilling its responsibilities under this Agreement. Both parties concur that the Member maintains “direct control” over the use of “education records,” as these terms are defined under FERPA. MHA agrees to comply with its obligations under FERPA, including but not limited to the limitations on re-disclosure of personally identifiable information from education records stipulated in FERPA and with the terms set forth below.
This implies that the Member is required to notify the parents/guardians of those students about the personally identifiable information that it will collect and share with us, and obtain parental/guardian consent prior to the students signing up or using the Services. When obtaining such consent, the Member is required to provide parents/guardians with a copy of our Privacy Policies. The Member must retain all consents on file and provide them to us upon request. Additionally, the Member bears the responsibility of verifying the student-parent relationship and ensuring compliance with the right of a parent to review personal information provided by the child. The Member is required to comply with such requirements by requesting and providing MHA with a data subject request for the aforementioned data, or any changes to such data requested by the parent, and providing the data to the parent after verification of the student-parent relationship. If the Member is located outside of the United States, MHA will rely upon the Member to obtain any required consents or approvals from the parent or guardian of any student covered by similar laws and, as a condition to the Member’s and its students’ use of the Services, the Member is required to comply with such laws.
MHA Privacy Policy for Children
In accordance with the Children’s Online Privacy Protection Act of 1998 and the U.S. Family Educational Rights and Privacy Act (“FERPA”), collectively referred to as “COPPA”, we are obligated to inform parents and legal guardians (“parents”) about our procedures for collecting, utilizing, and disclosing personal information from children. Additionally, we are required to obtain verifiable consent from a child’s parent for certain collection, use, and disclosure of the child’s personal information.

Calendar Information: A MHA User may connect their calendar with MHA. Our calendar integration only checks the duration and free/busy status of the events in your calendar to prevent booking you when you’re busy. We never store who you are meeting with, their email address, the meeting title, or any other details about the appointments in your connected calendar.

Billing Information: If you subscribe to MHA’s services, our third-party payment processors will collect and store your billing address and credit card information. We store the last four digits of your credit card number, card type, and the expiration date.
Information We Collect Directly
To register a child with this website, we require the following information: the child’s first name, last name, and an email address. Additionally, the creation of a password is necessary. We may request further information, but provision of this information is optional. We clearly indicate whether the information we request is required or optional at the time of request.
